D.Pushparaj v. Union Bank of India

ORDER (Order of the Court was made by G.Arul Murugan,J.) The writ petition is filed by the auction-purchaser seeking a direction to the first respondent to consider his representation and handover physical possession of the property.

¶2Learned counsel for the petitioner submits that the application filed under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, by the Bank was disposed of on 09.02.2024 and in such circumstances, the Bank is liable to handover possession of the property to the petitioner.

¶3Learned counsel for respondents 2 to 10 submits that some of the sale notices are challenged in S.A.No.127 of 2024. Further, the auction conducted and the sale certificate issued in favour of the petitioner is also a subject-matter of challenge in S.A.No.93 of 2026.

¶4In view of the fact that sale notices and sale certificate issued in favour of the petitioner are pending adjudication in the securitisation appeals, the relief sought for by the petitioner in this writ petition cannot be considered. Thus, it is open to the petitioner to get himself impleaded in the pending appeal proceedings, if not already a party, and obtain appropriate orders. Page4 of 5
