ORDER The petitioner, who apprehends arrest at the hands of the respondent Police for the offences punishable under Sections 303(2), 326(a) of BNS Act, Page2 of 6 2023 and 21(5) of the MM Act, 1957 in Crime No.86 of 2026 on the file of the respondent Police, seeks anticipatory bail.
¶2The learned counsel for the petitioner, pleading innocence on the part of the petitioner and false implication in the case, seeks indulgence of this Court. He submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Therefore he prayed to grant anticipatory bail to the petitioner.
¶3The case of the prosecution as put forth by the learned Government Advocate (Criminal Side) appearing for the respondent police, opposing for grant of anticipatory bail, is that the petitioner has transported ¼ unit of river sand without permission in a four wheel bullock cart, no previous case is pending against the petitioner.
¶4Having heard the learned counsel for the petitioner, the learned Government Advocate (Criminal Side) appearing for the respondent police and perused the materials available on record and considering that the petitioner has transported ¼ unit of river sand without permission in a four wheel bullock Page3 of 6 cart, no previous case is pending against the petitioner, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.
