ORDER This Criminal Original Petition has been filed challenging the order dated 04.05.2026 passed in Crl.M.P.No.1049 of 2026 in Crl.M.P.No.1065 of 2025 in C.S.R.No.97 of 2025 by the learned Judicial Magistrate No.I, Tambaram, dismissing the modification petition filed by the petitioner to substitute bank account details for the transfer of the frozen amount.
¶2In view of the final order to be passed in this petition at the admission stage itself, notice to the respondents 2 to 4 is dispensed with.
¶3The learned counsel for the petitioner submitted that the petitioner is a victim of the cyber fraud. He further submitted that the Trial Court had Page3 of 7 ordered the return of a sum of Rs.1,29,180/- to the petitioner. However, the bank account details previously furnished by the petitioner before the Trial Court are currently non-operational. As that specific account has been frozen in connection with a different transaction, the petitioner filed a modification petition before the Trial Court, which was rejected. Hence, the present petition.
¶4The learned counsel for Government of Tamil Nadu (Criminal Side) appearing for the first respondent submitted that the Trial Court rightly rejected the petition upon finding that the grounds raised therein were based on vague and unsubstantiated averments.
¶5This Court considered the rival submissions made on either side and perused the reasons contained in the impugned order.
¶6While no exception can be taken to the findings of the learned Judicial Magistrate as parties are expected to be diligent and provide accurate information before the Trial Court, this Court takes into account the plea that the error was not intended to cause any mischief but was Page4 of 7 merely an innocuous mistake committed by the petitioner.
¶7In view of the above, this Court is of the opinion that the requested modification can be permitted. Accordingly, the sum ordered to be returned to the petitioner shall be deposited into the following bank account: Mrs.Majeetha Parveen S M, Indian Overseas Bank, Account No: 019101000049868, MCC Branch, Tambaram, IFSC: IOBA0000191.
¶8Accordingly, the order of the Trial Court stands modified to the extent indicated above and this Criminal Original Petition is ordered. 30-06-2026 Sni Page5 of 7 To
