Judgment
ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the second respondent to consider the representation of the petitioner dated 16.03.2026, and to grant land assignment in favour of the petitioner for the land measuring 7 Acres, situated in S.F. No. 28/2, R. Pudupalayam Village.
¶2The petitioner claims that his father, a landless farmer, reclaimed approximately 7 acres of Tharisu Poramboke land situated at the foothills of Podhamalai Hills in R. Pudupalayam Village, Rasipuram Taluk, Namakkal District, around 40 years ago. Following the reclamation, he developed the land by digging an open well for irrigation and constructing a dwelling house. Since Page2 of 6 then, the family has been in continuous possession and peaceful enjoyment of the said property.
¶3The petitioner submitted an application in 2006 seeking assignment of the said land, pursuant to which the second respondent directed the fourth respondent to conduct an enquiry and submit a report. However, no consequential action was taken. Despite submitting a fresh representation dated
01.04.2026, the petitioner's request remained unconsidered. Aggrieved by the inaction of the respondents, the petitioner has filed the present Writ Petition seeking appropriate relief.
¶4The learned counsel for the petitioner further submitted that since the petitioner has been in continuous possession and enjoyment of the property for more than 40 years, he is entitled to an assignment patta in terms of the regulations contained in the Revenue Standing Orders.
¶5The learned Government Counsel appearing for the respondents submitted that after due verification of the petitioner's possession, and in Page3 of 6 accordance with the Revenue Standing Orders, the representation of the petitioner would be considered and necessary orders would be passed on merits.
¶6Considering the facts and circumstances of the case, and noting that the petitioner has been in continuous possession and enjoyment of the property for more than 40 years while actively carrying out agricultural activities on the said land, this Court, without going into the merits of the matter, directs respondents 2 to 4 to consider the petitioner's representation on its own merits and in accordance with the law. Appropriate orders shall be passed after issuing due notice to the petitioner and affording him a reasonable opportunity of a personal hearing to put forth his case. This exercise shall be completed within a period of six (6) weeks from the date of receipt of a copy of this order.
¶7With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs. 08-07-2026 Asi Page4 of 6 To
