WP 21762/2026

Judgment

ORDER By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

¶2This Writ Petition has been filed seeking for issuance of a Writ of Mandamus, directing the respondents 1 to 4 to consider the petitioners' representation dated 26.02.2026 and thereby direct the respondents to allot the plot which is in possession of petitioners in Survey No.866/3 part situated at New Anna Nagar, Tirumullaivoyal Village, Avadi Taluk, Tiruvallur District. Page14 of 17

¶3It is submitted by the learned counsel for petitioners that earlier a Writ Petition in W.P.No.5557 of 2026 was filed by petitioners, who had formed an Association. However, since there was some doubt as to the maintainability or otherwise of the said writ petition being filed by an Association, petitioners have come up by way of the present Writ Petition as individual members of the said Association.

¶4Learned counsel for petitioners also would submit that in terms of G.O.Ms.No.370, Revenue Department Ni.Mu.5(2), dated 09.07.1999, petitioners are eligible for being allotted housing plots. He would also submit that they have been in possession of the subject property for over four decades and that similarly placed individuals have been allotted housing plots. It is in such circumstance, petitioners have submitted a representation dated

26.02.2026, which is still pending consideration.

¶5Learned counsel for respondents 3 and 4 would submit that representations would be considered and orders passed thereon would be communicated to respondents 1 and 2. Learned Standing Counsel appearing for respondents 1 and 2 also agreed to act on such orders / communication in accordance with law. Page15 of 17

¶6Taking note of the submissions made by the learned counsel appearing on either side, this Court directs respondents 3 and 4 to consider petitioners' representations independently and pass appropriate orders on merits and in accordance with law, after issuing notice and after affording reasonable opportunity of hearing to petitioners and any other interested persons within a period of eight (8) weeks from the date of uploading of web copy without waiting for receipt of certified copy of the order. Any orders passed would also be communicated to respondents 1 and 2 to act on the same, in accordance with law. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the case on its own merits and in accordance with law.

¶7With the above direction, this Writ Petition stands disposed of. No Costs. 10-06-2026 (2/2) Index: Yes/No Speaking/Non-speaking order ANU Page16 of 17 To
