ORDER This Transfer Civil Miscellaneous Petition has been filed to withdraw the case in M.O.P.No.540 of 2025 on the file of the Family Court, Puducherry and transfer the same to the Family Court, Chennai.
.Heard learned counsel for the petitioner and perused the materials available on record.
.Learned counsel for the petitioner submits that the respondent filed a petition in M.O.P.No.540 of 2025 before the Family Court, Puducherry, seeking dissolution of marriage. He submits that the petitioner's father is acting as his Power Agent, who is aged 70 years and he finds it extremely difficult to travel frequently from Chennai to Puducherry for attending the Court proceedings. Further, the petitioner's minor son is under the care and custody of his aged parents at Chennai. He further submits that due to the petitioner's father's advanced age and health related constraints and continuation of the proceedings at Puducherry would cause considerable hardship and inconvenience to the petitioner and his family. Therefore, he prays to transfer the case to the Family Court, Chennai. Page3 of 6
.Learned counsel for the respondent raises objection and submits that the respondent is residing in Puducherry and it will be very difficult for her to attend the Court proceedings at Family Court, Chennai.
.I have gone through the affidavit filed in support of the transfer petition as well. I find merit in the submission made by the learned counsel on either side.
.Considering the facts and circumstances of the case, the submission made by the learned counsel on either side and considering the fact that the petitioner's son is under the care and custody of aged parents and the petitioner's father is acting as his Power Agent, who is aged 72 years, this Court is inclined to transfer the case on the file of the Family Court, Puducherry to the file of the IV Additional Family Court, Chennai. Accordingly, the case in M.O.P.No.540 of 2025 is hereby withdrawn from the file of the Family Court, Puducherry and transferred to the file of the IV Additional Family Court, Chennai. After receipt of the case papers from the Family Court, Puducherry, the IV Additional Family Court, Chennai is directed to send a notice to both the parties within four weeks. After due service of notice, the IV Additional Family Court, Chennai is directed to proceed with the matter in the manner known to law. Page4 of 6
.Considering the fact that the petitioner is working in Canada and the respondent is living in Puducherry, this Court is inclined to permit both the parties to appear through the Video Conferencing mode before the Family Court, Chennai. However, it is made clear that both the parties shall appear before the Family Court, Chennai as and when required.
.Accordingly, this Transfer Civil Miscellaneous Petition is allowed. No costs. Consequently, connected Civil Miscellaneous Petition is closed. 25-06-2026 Index: Yes/No Speaking/Non-speaking order PAM Page5 of 6 To
