Judgment
ORDER Orders in original dated 14.11.2025 & 15.11.2025 and an appellate order dated 05.05.2026 are assailed on the ground of alleged breach of principles of natural justice.
¶2Mr. R. Sethu Prabakaran, learned Government Counsel (Tax), accepts notice on behalf of both the respondents.
¶3Learned counsel for the petitioner submits that the appeal was lodged beyond the condonable period by making 10% pre-deposit. Subject to giving credit thereto, he submits that an additional 15% of the tax demand will be remitted by the petitioner as a condition for remand. An endorsement to that effect is made on the bundle.
¶4Subject to the condition that the petitioner remits 15% of the disputed tax demand, as agreed to, after giving credit to the 10% pre-deposit earlier made by the petitioner, within thirty days from the date of receipt of a copy of this order, the order in original is set aside and the matter is remanded to the first Page3 of 4 respondent for re-consideration. After providing a reasonable opportunity to the petitioner, a fresh order shall be issued within three months from the date of remittance of 15% of the disputed tax demand.
¶5The writ petition is disposed of on the above terms. Consequently, connected miscellaneous petitions are closed. There shall be no order as to costs. 01-07-2026 Index : Yes/No KJ To
