Judgment

ORDER This petition has been filed seeking direction to the 1st respondent to make measurement of the land in S.No.482/2K, 188 Sq. meter extent site in light of the Decree and Judgment passed in Second Appeal No.340 of 2023 dated 09.01.2026 situated at property Devikapuram Village, Arani Taluk now Chetpet Taluk, Tiruvannamalai with aid of 2nd respondent police protection.

¶2A perusal of the records reveals that the counter-parties, namely respondents 3 to 7, filed a suit for declaration regarding the subject property in O.S. No. 290 of 2007 on the file of the District Munsif-cum-Judicial Magistrate, Arani, which was initially decreed in their favour. However, in the first appeal (A.S. No. 7 of 2015) before the Subordinate Judge, Arani, the said decree was set aside, and the suit filed by respondents 3 to 5 herein was dismissed. The petitioner has now submitted representations to survey the property and has sought police protection for the same. Admittedly, respondents 3 to 7 had filed the suit for declaration, and the possession of the subject property was ordered to be taken by respondents 3 to 5. The petitioner has indirectly filed this petition to survey the land and seek police protection. However, respondents 3 to 5 ought to have taken steps to recover possession from respondents 3 to 7. Until possession of the property is recovered, the petitioner cannot seek a survey of the property. Page4 of 5

¶3In view of the above, the prayer sought for in this petition cannot be considered.

¶4Accordingly, this Writ Petition is dismissed. No costs. 06-07-2026 SMA To
