Judgment
Order (Order of the Court was made by Sunder Mohan J.) The petitioner who is a life convict has challenged the impugned order dated 02.09.2025 which is a communication sent by the Superintendent of Central Prison, Coimbatore to the Tahsildar, Kothagiri Taluk, Nilgiris District requesting Tahsildar to issue notice to the convict's relatives for execution of sureties on behalf of the petitioner.
¶2It appears that the petitioner's request for Ordinary Leave was considered favourably and an order was passed on 26.08.2025 by the Superintendent of Prison. The said order neither stipulates an escort nor requires blood relatives as sureties. The writ petition has been filed on the premise that the Tahsildar would insist on blood relatives as sureties.
¶3The learned Government Advocate (Criminal Side) appearing for the respondents however on instructions would submit that, they would not insist on Page2 of 4 blood relatives as sureties as that is not a condition on which the leave was granted to the petitioner.
¶4At this stage, the learned counsel for the petitioner prayed that the petitioner may be permitted to offer sureties before the Superintendent of Prison.
¶5In the facts and circumstances of the case, we are of the view that that the said request can be acceded to.
¶6Accordingly the petitioner is permitted to produce sureties before the Superintendent of Prison instead of the Tahsildar.
¶7With the above directions, this Writ Petition is disposed of. No costs. Connected Miscellaneous Petition is closed. (A.S.M.,J.) (S.M.,J.) 22-06-2026 mpl Index: Yes/No Speaking/Non-speaking order Page3 of 4 DR.ANITA SUMANTH J. AND SUNDER MOHAN J. MPL To
