ORDER This Criminal Original Petition seeks to quash the FIR in Crime No.119 of 2026 on the file of the 1st respondent Police for alleged offences under Sections 296(b), 115(2), 118(1) & 351(3) of BNS, on the ground of compromise between the parties. The parties are present before the court and, on examination, stand by their compromise and do not want the case to proceed further.

¶2The broad contours of the High Court's power to exercise extraordinary jurisdiction under Section 482 of the Cr.p.c. and Section 528 of the BNSS in respect of compromise of non-compoundable offences are laid down by the Hon'ble Supreme Court of India in Gian Singh -Vs-State of Punjab and Another (2012 10 SCC 303) and other subsequent judgments.

¶3The background facts in which the case is registered is that the de facto complainant as well as the accused are persons acquainted with each other. On the day of occurrence, there arose a wordy quarrel, on account of which, the Page3 of 4 offences of abusing and also attacking the de facto complainant is alleged. Subsequently, the parties have ironed out the differences.

¶4Even though this case is filed for quashing the First Information Report, when the matter came up for hearing, the learned Government Advocate (Crl. Side) would submit that already charge sheet has also been filed before the XVII-Metropolitan Magistrate, Saidapet in LTN20230000809C202600148.
