Judgment

ORDER The writ petition has been filed to direct the first respondent to consider petitioner's representation dated 09.04.2026 seeking payment of subsistence allowance for the period of suspension from 21.03.2025 and consequently, to disburse the subsistence allowance.

¶2Mr.K.Sathish, learned Government Advocate, accepts notice on behalf of the respondents. With the consent of both sides, the writ petition is taken up for final hearing at the admission stage itself.

¶3The petitioner is working as a Junior Assistant in the Thirupathur Municipal Corporation. Due to serious health issues, the petitioner underwent continuous medical treatment from 21.10.2024 and was hospitalised from

18.11.2024 to 26.11.2024, thereby, she was not able to attend her duties during the said period. Subsequently, the first respondent issued a show cause notice alleging unauthorized absence, for which, the petitioner submitted a detailed explanation along with all necessary documents. However, without conducting any proper enquiry or affording an opportunity of personal hearing, the first respondent placed the petitioner under suspension vide proceedings dated Page No.3 of 4

21.03.2025. Though the suspension order contemplated payment of subsistence allowance as per the applicable service rules, no subsistence allowance has been paid to the petitioner till date. Hence, she gave a representation dated

09.04.2026 seeking payment of subsistence allowance, for which there is no response till date. Therefore, the petitioner is before this Court.

¶4Heard the learned counsel on either side and perused the materials available on record.

¶5Considering the relief now sought for by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the first respondent to consider the petitioner's representation dated 09.04.2026, on merits and in accordance with law and to pass appropriate orders, within a period of four weeks from the date of receipt of a copy of this order.

¶6Accordingly, the writ petition is disposed of. No costs. 29-06-2026 Index: Yes/No rap Page No.4 of 4
