The suit has been filed in respect of termination benefits payable to the plaintiffs. It is stated that in order to obtain urgent orders, the statutory notice under Section 80 of C.P.C., has to be dispensed with.
¶3Considering the nature of the suit and the reasons stated in the affidavit filed in support of this application, this Court raised a query regarding the maintainability of the suit without impleading the Government as a party.
¶4The learned counsel appearing for the applicants pointed out that Section 80 of C.P.C., applies to a suit against the Government or against a Public Officer in respect of any act purporting to be done by such public officer Page4 of 6 in his official capacity. It is contended that even in the absence of the Government being impleaded as a party, the suit is maintainable against the Public Officers concerned. ¶5Considering the submissions made by the learned counsel for the applicants and having regard to the facts and circumstances of the case, this Court is of the view that it is appropriate to allow this application. Accordingly, notice under Section 80 of C.P.C. is dispensed with.
