WP No. 24415 of 2026 Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondents to disburse the earned leave calculated at the rate of 32 days per year from

Page3 of 6 For Petitioner(s): In both W.Ps Mr. N.Jayabharathi For Respondent(s) : In both W.Ps Mr. Sathish, Government Advocate for R1, Mr. S.Arun Kumar,Standing Counsel for R2 COMMON ORDER The writ petition are filed seeking a mandamus to direct the respondents to disburse the earned leave calculated at the rate of 32 days per year from
1.01.1990 till the date of petitioners' retirement together with interest 18 percent per annum for the delayed period from 31.05.2022 and 31.05.2024 till the date of payment at the earliest.
¶2It is the case of the petitioners' that they were appointed in the Tamil Nadu Dairy Development Corporation as Casual Labourers and had retired from service as Special Grade Senior Factory Assistant and Technician on
31.05.2022 and 31.05.2024 under the 2nd respondent. The petitioners' were entitled to leave encashment benefit of 240 days of Earned Leave and the respondents are legally bound to pay the same at the time of their retirement, however, it was not paid to them till date. Therefore, the petitioners' made a representation to the respondents on 09.03.2026 and 16.03.2026 to pay the Page4 of 6 benefits along with the interest. Since there is no response, the petitioners' are before this Court.
¶3Heard the learned counsel on either side and perused the materials available on records.
¶4Admittedly, the leave encashment benefits have not been paid to the petitioners' through no fault of their own. Therefore, the petitioners' are entitled to the same along with the interest for the belated payment. Hence, the mandamus is issued directing the respondents to disburse the benefits along with 6% interest for belated payment within a period of twelve (12) weeks from the date of receipt of a copy of this order.
¶5With the above direction, the writ petitions are disposed of. No costs. 29-06-2026 Index: Yes/No Speaking/Non-speaking order SRN Page5 of 6 To Krishnagiri District Co-operative Milk producer Union, Krishnagiri WPoNo.o24413oofo2026 P.T.ASHAoJ.
