Judgment

ORDER This writ petition has been filed for direction to respondents 1 to 3 to accord police protection to the petitioner in discharging his duties as Hereditary Muthawalli of Syed Ameenuddin Shah Aulia Chisti Tomb Wakf at Vellore Old Bus Stand, Vellore as per directions of the Tamil Nadu Wakf Board as sought vide representation dated 01.06.2026.

¶2The petitioner seems to have been appointed as Hereditary Muthawalli of Syed Ameenuddin Shah Aulia Chisti Tomb Wakf, Vellore in the place of one, Jeelani. It was challenged before the Tamil Nadu Wakf Tribunal in OA.No.59 of 2025. The said Jeelani also filed interim application in IA.No.333 of 2025 seeking injunction. However, it is pending for consideration before the Wakf Tribunal. Pending challenge of the appointment of the petitioner as hereditary muthawalli, the petitioner submitted representation seeking police protection in the interim application and the same was dismissed, which was confirmed by this Court. Further, this Court directed the Tamil Nadu Wakf Tribunal to dispose of the OA.No.59 of 2025 within a period of six months in AS.No.497 of 2026 by order dated 30.04.2026. Now, original application is also pending for adjudication. Pending the said application, the petitioner has submitted representation seeking police protection to discharge his duties as hereditary muthawalli of Syed Ameenuddin Shah Aulia Chisti Tomb Wakf, Vellore. In AS.No.497 of 2026, already the Tamil Nadu Wakf Tribunal was directed to dispose of the OA.No.59 of 2025 itself within a period of six months by order dated 30.04.2026. Therefore, till the disposal of the original application in OA.No.59 of 2025, the request made by the petitioner seeking police protection, to discharge his duties as hereditary muthawalli of Syed Ameenuddin Shah Aulia Chisti Tomb Wakf, Vellore, cannot be considered. As such, this writ petition is liable to be dismissed.

¶3However, the petitioner is at liberty to approach Wakf Tribunal for appropriate relief. It is also made clear that the petitioner can very well seek police protection subject to the result of OA.No.59 of 2025.

¶4At this juncture, the learned counsel for the petitioner submits that the petitioner is now continuing as hereditary muthawalli of Syed Ameenuddin Shah Aulia Chisti Tomb Wakf, Vellore.

¶5Therefore, if at all there is any threat at the hands of the former muthawalli, the petitioner can lodge a complaint before the jurisdictional police and on receipt of the same, the jurisdictional police shall deal with the complaint in accordance with law.

¶6With the above direction, this writ petition is dismissed. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
