Judgment
ORDER Earlier, this Court on 23.03.2026, had directed the petitioner to operate the amount. However, the petitioner was refrained from operating the amount for which reason the petitioner approached this Court by filing a Contempt Petition, which was closed on 05.06.2026, pursuant to which the petitioner is before this Court seeking clarification on the same.
¶2The learned counsel for the petitioner submits that the attachment of the property in S.No.309/1 situated at Saraswathi Nagar, Karthikeyapuram Village, Tiruttani Taluk still holds good. It is made clear that this Court had only quashed the sale process and not the attachment.
¶3The learned counsel for the petitioner further submits that the property will not be and cannot be encumbered in any manner. Further the learned counsel argued that it is mentioned in the sale proclamation notice that the properties are valued at Rs.4,35,00,000/-.
¶4Since the property worth about Rs.4,35,00,000/- is already under attachment, even according to the counsel for the petitioner and not disputed by the counsel for the Respondent, the bank account of the petitioner can be operated.
¶5Accordingly, the petitioner can operate his bank account and the concerned respondent shall instruct the bank to permit the petitioner to operate his bank account.
¶6With the above observation, this petition is closed. K. SURENDER,J. 20-07-2026
