ORDER This Civil Revision Petition has been filed challenging the impugned order dated 25.04.2025, passed by the V Additional Family Court at Chennai in I.A.No. 1 of 2024 in O.P.No.4670/2023.
¶2In the aforesaid order, the V Additional Family Court has fixed the interim maintenance payable by the respondent to the petitioner @ 20,000/- per month. The V Additional Family Court at Chennai had also directed the respondent to pay the arrears of interim maintenance @ 20,000/- per month to the petitioner, within three months from the date of the impugned order. The petitioner who is the wife, unsatisfied with the quantum of interim maintenance fixed by the Court below has filed this Civil Revision Petition.
3.As seen from the impugned order, the petitioner was earlier employed and her bank statement was also taken into consideration by the V Additional Family Court at Chennai. However, learned counsel for the petitioner would submit that the petitioner is presently unemployed. He would submit that she is the soley dependent on her parents income for her survival. He would further submit that though the petitioner had claimed a sum of Rs.1,10,000/- as interim Page3 of 5 maintenance in I.A.No.1 of 2024, the V Additional Family Court at Chennai under the impugned order has granted only Rs.20,000/- per month which is too low and the said amount cannot be sufficient for the petitioner's survival.
¶4The contention of the petitioner is disputed by the learned counsel for the respondent.
¶5After hearing the submissions of both the counsels for quite some some, this Court suggested to both the counsels as to whether a sum of Rs.30,000/- per month can be fixed as interim maintenance payable by the respondent to the petitioner till the disposal of the H.M.O.P. No.4670 filed by the respondent seeking for dissolution of marriage with the petitioner.
¶6Both the counsels, on instructions fairly agreed to the suggestion given by this Court. This Court appreciates their decision.
¶7For the foregoing reasons, this Civil Revision Petition is disposed of by directing the respondent to pay interim maintenance to the petitioner @ 30,000/- per month on or before 5th of every english calender month and shall pay the arrears of interim maitenance @ Rs.20,000/- per month from the date of filing of I.A.No.1 of 2024 by the petitioner, after adjusting the amounts already paid by the respondent to the petitioner, within a period of six weeks from the date of receipt of a copy of this order. The Interim stay granted by this Court on
09.07.2025, in this Civil Revision Petition stands vacated and the learned V Page4 of 5 Additional Judge, Family Court, Chennai is directed to entertain the application filed by the petitioner seeking to setaside the exparte order and allow the same and thereafter dispose of H.M.O.P.No.4670 of 2023, within a period of one year from the date of receipt of a copy of this order.
