Judgment

O R D E R This Criminal Miscellaneous Petition has been filed seeking relaxation of condition imposed in Para No.4 (c) of the order dated 24.11.2025 made in Crl.M.P.No.22279 of 2025, whereby the petitioner was directed to appear Page1 of 4 before the Trial Court on every Tuesday at 10.30 a.m., till the disposal of the Criminal Revision Case. The said condition reads as follows: "4(c) The petitioner shall appear before the Trial Court on every Tuesday at 10.30 a.m., until the disposal of the Criminal Revision and if he is not able to appear before the trial Court on any day, he shall make arrangements to file an application under Section 355 of BNSS, 2023 and shall appear before the trial court on any other day in lieu of the date of his absence, as directed by the trial Court."

2.The learned counsel for the petitioner submitted that the petitioner has complied with all the conditions imposed by this Court. It is further submitted that the petitioner has been regularly appearing before the Trial Court every Tuesday without any default. However, the petitioner is presently employed in the State of Kerala and, on account of his employment, he is finding it difficult to comply with the condition requiring his weekly appearance before the Trial Court. It is therefore prayed that the said condition may be relaxed.

3.Considering the submissions made by the learned counsel for the petitioner, the fact that the petitioner has complied with the earlier conditions imposed by this Court, and taking note of his employment outside the State, this Court is of the view that the request for relaxation deserves acceptance.

4.Accordingly, the condition imposed in Para No.4 (c) of the order dated

24.11.2025 made in Crl.M.P.No.22279 of 2025 in Crl.R.C.No.2511 of 2025 is modified as follows:- Page2 of 4 "4(c) The petitioner shall appear before the Trial Court on the 1st working day of every English calender month at

10.30 a.m., commencing from the month of August, 2026, until the disposal of the Criminal Revision and if he is not able to appear before the trial Court on any day, he shall make arrangements to file an application under Section 355 of BNSS, 2023 and shall appear before the trial court on any other day in lieu of the date of his absence, as directed by the trial Court."

5.Except to the above extent, all the other conditions imposed by this Court in the order dated 24.11.2025 shall remain unaltered and shall be complied with by the petitioner.

6.With the above modification, this Criminal Miscellaneous Petition is allowed.

7.Put up Crl.R.C.No.2511 of 2025 for 'final disposal' on 11.08.2026. In the meantime, the learned counsel for the petitioner is directed to bring the translated copy of all the documents annexed with the petition. 15-07-2026 Index: Yes/No GSA Page3 of 4 CRLoMPoNo.o10958oofo2026 SHAMIMoAHMEDoJ.
