¶2The case of the prosecution is that while the victim was lonely at home, the accused person with sexual intent has attempted the aggravated sexual assault on victim. Again, he has attempted to commit the same. Hence the complaint.

¶3The learned counsel for the petitioner submitted that the petitioner reprimanded the victim girl for having affair with someone else, hence, she has given this false complaint. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the Petitioner.

¶4Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and strongly opposed the grant of bail to the petitioner.

¶5I have given my anxious consideration to either side submissions and perused the materials available on record.

¶6Considering the facts and circumstances of the case; taking note of the Page3 of 5 submission made by the learned Government Advocate (Crl.Side) and on perusal of the 183 statement, there is reference about the victim's affair with another person. Hence, taking into consideration of the totality of the circumstances, the period of incarceration of the petitioner since 19.02.2026, this Court is inclined to grant bail to the petitioner, subject to certain conditions.

¶7Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each, for a like sum to the satisfaction of the learned Sessions Judge, POCSO Court, Vellore, and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019'].
