O R D E R This civil revision petition has been filed seeking to set aside the order dated 13.02.2025 passed in I.A. No. 1 of 2024 in M.C.O.P. No. 228 of 2010 by the Exclusive Motor Accidents Claims Tribunal, Tiruppur.
¶2By the aforesaid order, the application filed by the petitioner, who is the respondent in the claim petition, seeking to condone the delay of 4366 days in filing the application to set aside the ex parte award dated 26.11.2012 passed against the petitioner has been dismissed on the ground that the conditional order passed by the Tribunal on 08.01.2025 directing the petitioner to deposit a sum of Rs.3,50,000/- on or before
12.02.2025 was not complied with.
¶3At the time of filing of this civil revision petition challenging the said order, the petitioner had not deposited the sum of Rs.3,50,000/- as directed by the Motor Accidents Claims Tribunal. However, learned counsel for the petitioner would submit that on 2\4
02.08.2025, a sum of Rs.3,50,000/- has been deposited to the credit of M.C.O.P. No. 228 of 2010. Learned counsel has also produced a copy of the Demand Draft dated 02.08.2025 for a sum of Rs.3,50,000/- favouring the 'The Presiding Officer, E-MACT, Tiruppur, MCOP NO-0228/10' to prove that a sum of Rs. 3,50,000/- has been deposited to the credit of M.C.O.P. No. 228 of 2010. Moreover, on a perusal of the order dated 08.01.2025, it is seen that the Tribunal had observed that the respondents/claimants had also endorsed that the petition in I.A. No. 1 of 2024 may be allowed. The Motor Accidents Claims Tribunal, after referring to the same, in order to protect the interest of respondents/claimants, had directed the petitioner to deposit a sum of Rs.3,50,000/- to the credit of M.C.O.P. No. 228 of 2010. The said amount has also now been deposited by the petitioner as seen from the proof submitted by the learned counsel for the petitioner before this Court.
¶4Since the conditional order passed by the Exclusive Motor Accidents Claims Tribunal, Tiruppur, has been complied with, the order dated 13.02.2025 passed in I.A. No.1 of 2024 is hereby set aside and the delay in filing the application to set aside the ex parte award stands condoned. 3\4 ABDUL QUDDHOSE,J. nv
¶5Further, the ex parte award dated 26.11.2012 passed against the petitioner in M.C.O.P. No. 228 of 2010 by the Motor Accidents Claims Tribunal, Tiruppur, is also set aside by this Court by permitting the petitioner to file their counter statement to the claim petition filed by the respondents/claimants and by directing the learned II Additional District and Sessions Judge, Fast Track Court No.V, Coimbatore @ Tiruppur, to dispose of M.C.O.P. NO. 228 of 2010 within a period of six months from the date of receipt of a copy of this order.
¶6The civil revision petition stands allowed with the above directions. No costs. Connected C.M.P. is closed.
