Judgment
ORDER The petitioner/de facto complainant, on whose complaint a case in Crime No.205 of 2025 for offence under Sections 281, 125(a) of BNS, 2023 and Sections 134(a) and 134(b) of Motor Vehicles Act, 1988 registered, had filed this petition seeking transfer of investigation.
¶2The gist of the complaint is that the petitioner is a practising advocate. On 21.11.2025 at about 3.00 p.m. the petitioner was proceeding on his Activa two wheeler from the Madras High Court to the Thiruvottriyur Court. The pillion rider was his senior one Solomen Peter Kamal Doss. While they were driving down to the Royapuram Flyover, the two wheeler ahead of them suddenly stopped and hence, the petitioner lost control of his vehicle and both of them fell down. As both of them were wearing helmets, they did not sustain any head injuries but sustained fracture injuries. Though an F.I.R. registered and his senior has now passed away due to the accident, no action has been taken. Due to non-identification of the offending vehicle, the petitioner is unable to file any motor accident claim either for the injury sustained by him or for the family members of his senior Solomen Peter Kamal Doss. ¶3The learned Government Advocate (Criminal Side) submitted that photographs collected during investigation, but the photographs are not clear to fix the offending vehicle. He further submitted that necessary steps have been taken and final report will be filed shortly.
¶4Considering the fact that the accident occurred on 21.11.2025 and the offending vehicle still not identified, despite the accident took place in a busy area, where several CCTV cameras fixed by the private persons and the police also installed CCTV cameras in vital points, this Court is of the view that identifying the vehicle involved in the accident may not be a difficult task, but the investigating agency failed to identify the offending vehicle.
¶5In view of the same, this Court transfers the investigation in Crime No.205 of 2025, pending on the file of Inspector of Police, H-1, Washermenpet Traffic Investigation Wing, Chennai to the file of Assistant Commissioner of Police, Traffic Investigation Wing, Chintadripet. The Assistant Commissioner of Police, Traffic Investigation Wing, Chintadripet is directed to take up the investigation and file final report within a period of six months from the date of receipt of a copy of this order. The Deputy Commissioner of Police, Traffic North Beach, Chennai is directed to monitor the investigation. Page4 of 4 M.NIRMAL KUMAR J. RSI
