Judgment

ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing respondents 1 and 2 to complete the survey proceedings in respect of the petitioner's property comprised in Survey No. 113/4, measuring an extent of 0.26.00 Acres, situated at Mecheri Village, Mettur Taluk, Salem District, by demarcating the boundaries and fixing boundary stones pursuant to the petitioner's online application dated 19.12.2025; and consequently, to direct the third respondent to provide adequate police protection to the revenue officials and the petitioner for carrying out such proceedings without any interference, obstruction, or disturbance from respondents 4 and 5 or anyone claiming through them, within a time frame as may be fixed by this Court.

¶2When the matter was taken up for hearing today, the learned Government Counsel appearing for respondents 1 and 2 submitted that in respect of the property comprised in Survey No. 113/4, the survey had already been conducted on 06.05.2026 and a survey report has also been filed.

¶3A perusal of the survey report dated 06.05.2026 reveals that an extent of 50 sq. ft. in Survey No. 113/4 has been occupied and is in the possession of the 4th respondent, who has also constructed a house thereon. Page3 of 5

¶4In view of the above, this Court deems it inappropriate to direct the official respondents to measure the property and fix boundary stones once again. In the event that the petitioner intends to recover the said 50 sq. ft. of land, it is open to him to approach the competent Civil Court for recovery of possession in accordance with law. Therefore, this Court is not inclined to issue any further directions in this Writ Petition. Accordingly, this Writ Petition is dismissed. No costs. 22-07-2026 Asi To
