Judgment
ORDER The prayer in this criminal original petition is for a direction to transfer the investigation of the complaint dated 25.03.2026, made by the Page3 of 6 petitioner, to the 5th respondent.
¶2Upon hearing the learned counsel for the petitioner, the learned Government Advocate (Criminal Side) appearing for the respondents 1 to 4 and upon perusing the materials available on record, it is evident that the petitioner is complaining that he is the owner of the property and that certain persons, claiming to be members of the jamaat and asserting that the property is a waqf property, are interfering with his possession and enjoyment. It is further alleged that they are threatening the life and limb of the petitioner.
¶3In view of the threats made, the petitioner stated that a case should have been registered and investigated by the respondent police. Since they have not done so, the petitioner has sought a transfer of the investigation to the 5th respondent/CBI.
¶4Thus, it is clear that if the petitioner is aggrieved by the fact that no case has been registered based on his complaint, the remedy open to Page4 of 6 him as per the law laid down by the Hon'ble Supreme Court of India in Lalita Kumari Vs. Government of U.P. & Others (2014 (2) SCC 1) and the dictum of the Division Bench of this Court in G.Prabhakaran Vs. The Superintendent of Police (2018 2 LW (Crl.) 489), is to approach the appropriate Magistrate for the registration of the case. The question of transferring an investigation arises only post-registration.
¶5With the aforesaid liberty reserved to the petitioner, this criminal original petition stands disposed of. Connected miscellaneous petition is closed. 06-08-2026 Sni Page5 of 6 To
