Judgment
ORDER The petitioner, who was arrested and remanded to judicial custody on
06.03.2026 for the alleged offence under Sections 137(2), 65(1), 351(2) of BNS Act and Section 5(j)(ii), 5(n) r/w 6 of POCSO Act, in Crime No.6 of 2026 on the file of the respondent police, seeks bail. Page2 of 4
¶2The allegation against the petitioner is that the petitioner has committed a sexual relationship with the victim girl and also threatened her not to disclose the same to anyone. Hence, this case.
¶3The learned counsel appearing for the petitioner submitted that the petitioner was arrested and remanded to judicial custody since 06.03.2026. He further submitted that the investigation has been completed and the charge sheet has also been filed. He further submitted that the petitioner has been falsely implicated in the present case and that he has not committed any offence as alleged by the prosecution. Hence, he prays for grant of bail to the Petitioner.
¶4Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and strongly opposed the bail application and produced the 183 of BNSS, recorded from the victim by the learned Judicial Magistrate No.2, Tiruvannamalai on 12.03.2026. Hence, he opposed the grant of bail to the Petitioner.
¶5I have given my anxious consideration to either side submissions and perused the materials available on record.
¶6From the submissions made by the learned counsel on either side and also while considering the statement recorded under section 183 of BNSS it is Page3 of 4 seen that the victim is aged about 14 years and that there are serious allegations against the petitioner, who is aged about 27 years. Considering the severity of the allegation against the petitioner, this Court is not inclined to enlarge the petitioner on bail. Hence, this Criminal Original Petition is dismissed. 07-07-2026 DRL Note:
