ORDER The writ petition is filed seeking a mandamus to the 2nd respondent to consider the petitioner's representation dated 03.02.2026, to regularise the suspension period as duty and also to pay the petitioner his entitlements.
¶2The case of the petitioner is that he was appointed as Village Administrative Officer in Alekkundani Village in Krishnagiri District on
09.04.2012. Based on certain allegations, he was suspended from service on
17.12.2015, which later was revoked by the proceedings of the 2nd respondent dated 14.09.2015, and thereafter, he was posted at certain Taluks in Krishnagiri District. While so, the 2nd respondent issued a charge memo on 24.09.2018, setting out three charges against him, and as the same were disproved by the enquiry officer's report, he was discharged of all charges. However, ignoring the enquiry report, the 2nd respondent vide proceedings dated 20.04.2023, had held that Charge No.3 was proved against the petitioner and imposed him with a punishment of stoppage of increment for 6 months with cumulative effect.
¶3Aggrieved by the said proceedings, the petitioner had approached this Court in W.P.No.31778 of 2023 to quash the same. This Court by order dated
13.08.2025, had allowed the writ petition. Pursuant to the orders of this Court, the petitioner was reinstated into service, however, his suspension period was Page3 of 4 not regularised as duty period and no arrears of pay, allowances, increments, promotion and other benefits were paid to him. Therefore, the petitioner had approached the 2nd respondent with his representations on several occasions, and his last representation was on 03.02.2026. Since, there is no response from the 2nd respondent, the petitioner is before this Court.
¶4Heard the learned counsel on either side and also perused the materials placed on record.
5.Taking into account the fact that the petitioner had been reinstated into service pursuant to the orders of this Court, this Court directs the 2nd respondent to consider the representation of the petitioner dated 03.02.2026, and pass necessary orders within a period of eight weeks from the date of receipt of a copy of this order.
¶6With the above directions, the writ petition is disposed of. No costs. 02-07-2026 Index: Yes/No Speaking/Non-speaking order DS Page4 of 4
