Judgment

ORDER This Criminal Original Petition is filed to quash the proceedings in STC No.104 of 2026 on the file of the Court of District Munsif cum Judicial Magistrate, Ranipet District.

¶2I have heard Mr.D.Vijaya Babu, the learned counsel for the petitioner and Mr.Mohammed Riyaz, the learned Government Advocate (Criminal Side) appearing for the 1st respondent.

¶3Upon considering the final report that is filed it can be seen that the same is taken on file for the offences under section 189 (2) and 223 of BNSS, 2023. As far as the offence under Section 223 of BNSS is concerned, in view of the specific bar under Section 215 of BNSS, the FIR could not have been registered and the charge sheet could not have been filed as against the petitioners. Even with reference to the offences, upon considering the nature of allegations, it can only be seen that the petitioners have democratically exercised the right of protest with reference to a public issue on hand. I am of the view that no criminal offence is made out and accordingly the proceedings in STC No.104 of 2026 on the file of the Court of District Munsif cum Judicial Magistrate, Ranipet District shall stand quashed. Consequently, the connected miscellaneous petitions are closed. 03-07-2026 JER Page5 of 6 To
