Judgment
ORDER This Criminal Original Petition seeks to quash the FIR in Crime No.97 of 2026 on the file of the 1st respondent for alleged offences under Section 140(2) and later altered to Sections 140(2), 115(2), 118(1) and 351(3) of BNS, 2023, on the ground of compromise between the parties. The parties are present before the court and, on examination, stand by their compromise and do not want the case to proceed further.
¶2The broad contours of the High Court's power to exercise extraordinary jurisdiction under Section 482 of the Cr.p.c. and Section 528 of the BNSS in respect of compromise of non-compoundable offences are laid down by the Hon'ble Supreme Court of India in Gian Singh -Vs-State of Punjab and Another (2012 10 SCC 303) and other subsequent judgments.
¶3The brief facts leading to the registration of the case are that when the defacto complainant owed money to the accused persons, it is alleged that they wrongfully restrained him and tried to abduct him to a particular place. Subsequently, after the registration of the case, it is seen that the defacto complainant has paid back the amount and the parties have ironed out the differences. Page3 of 4
¶4Thus, it can be seen that this matter is a fit case for the exercise of extraordinary jurisdiction to quash the case on compromise.
¶5Accordingly, this Crl.O.P. No.21613 of 2026 stands allowed. The FIR in Crime No.97 of 2026 on the file of the 1st respondent stands quashed. Consequently, connected Criminal Miscellaneous Petition is closed.
¶6It is needless to stated that with reference to one of the Juvenile accused also the matter shall be treated as closed.
¶7Since the case itself quashed, it is submitted that the two cars were seized and produced before the concerned Court, it will be open for the concerned owner of the vehicles to file an application for return of property. As and when the application is filed, the same shall be favourably considered by the Court in accordance with law. 05-08-2026 smv Page4 of 4
