Case no.
CRL OP 17209/2026

Judgment

ORDER The petitioner, who was arrested and remanded to judicial custody on

16.05.2026 for the alleged offence under Sections 296 B, 232, 351(2) of BNS read with 4 of TNWH Act, 2002, in Crime No.57 of 2026 on the file of the respondent police, seeks bail. Page2 of 4

¶2The allegation against the petitioner is that the petitioner committed aggravated sexual assault on the minor victim girl and criminal intimidated the victim and her father. Hence, the present case has been registered against the petitioner.

¶3The learned counsel for the petitioner submitted that the petitioner was arrested and remanded to judicial custody since 16.05.2026. He further submitted that an earlier FIR is pending against the petitioner and that the present FIR has been registered only on the allegation that the petitioner threatened the witnesses when they came forward to depose before the Trial Court. He further submitted that there was a money dispute between the victim family and the petitioner family and that, out of vengeance, the present false case has been registered against him. Hence, he prays for grant of bail to the Petitioner.

¶4Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and submitted that PW.1 has already been examined before the Trial Court and the witnesses are yet to be cross-examined. He further submitted that, if the petitioner is enlarged on bail, there is every likelihood of his threatening or tampering with the prosecution witnesses. Hence, he opposed the grant of bail to the Petitioner. Page3 of 4

¶5I have given my anxious consideration to either side submissions and perused the materials available on record.

¶6From the submissions made by the learned Government Advocate (Crl.Side), it is seen that the present FIR relates to allegations of threatening the prosecution witnesses in connection with the earlier case pending against the petitioner. In such circumstances, this Court is not inclined to enlarge the petitioner on on bail Hence, this Criminal Original Petition is dismissed. 07-07-2026 DRL To
