¶2The case of the prosecution is that on 12.04.2026, at about 4.00pm, when the defacto complainant was attending his mother in law's brother's funeral, the petitioner, who was under the influence of alcohol, danced in front of the dead body, created nuisance and disturbance. When the same was questioned by the defacto complainant, the petitioner abused the defacto complainant in a filthy language and also attacked him using iron rod. During the course of the assault, the petitioner struck the defacto complainant on his left leg resulting in a fracture injury and other bodily injuries. Hence, the case.

¶3The learned counsel appearing for the petitioners submitted that the petitioner is an innocent persons and he been falsely implicated in the present case and that he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the Petitioner.

¶4The learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and submitted that both the petitioner and the defacto complainant are relatives and also submits the injured got admitted in the hospital on 12.04.2026 and discharged on 28.04.2026. He also submits no previous case is pending against the petitioner. However, he Page3 of 4 strongly opposed to grant anticipatory bail to the petitioner.

¶5I have given my anxious consideration to either side submissions and perused the materials available on record.

¶6Taking into consideration the gravity of the allegations against the petitioner and the submissions made by the learned Government Advocate (Criminal Side), this Court is of the firm view that enlarging the petitioner on anticipatory bail would shock the conscience of society. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
