Judgment
ORDER Mr.P.Siddarth, learned Government Counsel, accepts notice on behalf of respondents 1, 4, 5 and 7, and Mr.Durai Gunasekaran, learned Government Counsel, accepts notice on behalf of respondents 2, 3 and 6.
¶2The petitioner has approached this Court seeking a direction to respondents 1 to 7 to forbear respondents 8 to 10 from interfering with his peaceful possession and enjoyment of the subject properties.
¶3The petitioner submits that he had earlier instituted a suit for permanent injunction against the private respondents. During the pendency of the suit, the parties amicably settled their dispute before the Lok-Adalat, and a compromise decree came to be passed. According to the petitioner, despite the said settlement, respondents 8 to 10 continue to interfere with his peaceful possession of the property.
¶4If the private respondents have wilfully violated the compromise decree passed by the Lok-Adalat, the appropriate remedy available to the petitioner is to approach the jurisdictional court for enforcement of the decree or for appropriate action in accordance with law. The official respondents do not have any statutory obligation to initiate action against the private respondents merely on the ground of an alleged violation of the compromise decree.
¶5In view of the above, the Writ Petition is disposed of, reserving liberty to the petitioner to approach the appropriate forum for the relief sought in this writ petition. There shall be no order as to costs.
