ORDER Challenging the Lok Adalat Award dated 14.03.2026 passed in Lok Adalat Case No.273 of 2026 arising out of O.S. No.1280 of 2025 on the file of the learned First Additional District Judge, Coimbatore, the revision petitioners, who are third parties to the suit, have filed the present revision challenging both the decree and the settlement recorded by the Lok Adalat.
¶2The revision petitioners contend that the suit was instituted by suppressing the existence of the real legal heirs of Chinnia Gounder, S/o. Tirumalayappa Gounder. According to them, the first defendant, being one of the sons of the said Chinnia Gounder, instigated his daughter, Kavitha Mani, to file the suit as though he alone was the sole legal heir of Chinnia Gounder. Thereafter, the plaintiff and the defendants entered into a settlement before the Lok Adalat and divided the suit properties among themselves, to the exclusion of the other legal heirs.
¶3It is the specific case of the revision petitioners that the first defendant deliberately failed to disclose that Tirumalayappa Gounder had three daughters, namely Subbathal, Angammal, and Lakshmi, who are also legal heirs entitled to succeed to the estate. By suppressing these material facts and excluding the other legal heirs from the proceedings, the parties obtained a compromise decree before the Lok Adalat and thereafter attempted to alter the revenue records on the strength of the said award. Upon coming to know of these facts, the revision petitioners have approached this Court seeking to set aside the Lok Adalat Award and the consequential decree.
¶4In support of their contentions, the revision petitioners have produced the Legal Heir Certificate, which clearly discloses that Subbathal, Angammal, and Lakshmi are also legal heirs of the said Tirumalayappa Gounder. However, none of them were impleaded as parties to the suit, nor was their existence disclosed in the plaint. The suppression of the necessary legal heirs and the non-disclosure of these material facts vitiate the compromise recorded before the Lok Adalat. Therefore, the revision petitioners seek interference by this Court to set aside the impugned Lok Adalat Award and the decree passed pursuant thereto.
¶5Therefore this Court is inclined to grant leave to file a Civil Revision Petition against the Lok Adalat Award dated 14.03.2026 in Lok Adalat Case.No.273 of 2026 in O.S.No.1280 of 2025 on the file of the First Additional District Judge, Coimbatore.
¶6Accordingly, this Civil Miscellaneous petition is allowed. 25-06-2026 rri To
