¶4It is the case of the petitioners that they had joined the services of the respondent Corporation on various dates and retired from service on

28.02.2025, 31.06.2025 and 31.05.2025, respectively. However, their terminal Page6 of 8 benefits were settled belatedly without payment of any interest. Further, the petitioners retired from service prior to the wage settlement entered into under Section 12(3) of the Industrial Disputes Act, 1947, dated 29.05.2025, which was given retrospective effect from 01.09.2023. As per the said settlement, the petitioners are entitled to revision of pay and consequential terminal benefits such as difference in salary, surrender leave salary, dearness allowance, gratuity and pension etc. However, the said benefits have not been extended to the petitioners. In this regard, the petitioners had submitted their respective representations to the respondents. Since the said representations were not considered, the present Writ Petitions have been filed.

¶5The learned Standing Counsel for the 1st respondent submitted that they are willing to pay interest at 6% per annum on the delayed payment of the petitioners' eligible and admissible terminal benefits. They also agreed to pay the eligible and admissible differential amount of terminal benefits as per 12(3) Settlement, along with interest at 6% per annum.

¶6Heard the learned counsel for the petitioners and the learned Standing Counsel appearing on behalf of 1st respondent.

¶7In view of the above submission of the learned Standing Counsel, this Court deems it appropriate to direct the respondents to pay interest at the rate of Page7 of 8 6% p.a. for the belated payment of terminal benefits from the date of entitlement till the date of actual disbursal of the terminal benefits to the petitioners and to pay eligible differential amount of terminal benefits such as gratuity, earned leave salary, Dearness allowance, pension, etc., as per the 12(3) wage settlement along with interest at the rate of 6% per annum from the date on which the amounts became due till the date of actual payment. The said exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order.
