WP 26024/2026

Judgment

ORDER This writ petition has been filed seeking the issuance of a writ of mandamus directing the respondent to consider and dispose of the petitioner's representation dated 08.06.2026 and consequently correct the petitioner's date of confirmation in service as 2002 the year in which he completed the qualifying service, restore his seniority and grant all consequential service and monetary benefits including pay fixation, increments, promotional benefits and arrears.

¶2It is the case of the petitioner that he was appointed as a Daily Wage Conductor in the respondent Transport Corporation in 1998 through the Employment Exchange and has been serving continuously without any break in service. He completed the required 240 days of continuous Page3 of 6 service before the year 2002 and became eligible for confirmation in service. However, the respondent Corporation had wrongly confirmed his services only in the year 2005. As a result, the petitioner suffered a loss of seniority, pay fixation, annual increments, promotional opportunities, pensionary

benefits

and

other

service

benefits. The respondent sought to justify the delayed confirmation by relying on G.O.Ms.No.212 dated 29.11.2001 and G.O.Ms.No.58 dated 08.11.2002 relating to the recruitment ban. According to the petitioner, the said Government Orders apply only to fresh appointments and not to employees who had already completed the qualifying service before the recruitment ban. The petitioner relied upon the judgment of this Court in W.P.No.31831 of 2012 dated 29.01.2018, wherein it was held that employees who had completed the qualifying service prior to the recruitment ban are entitled to confirmation from the appropriate date with all consequential benefits. The petitioner submitted a representation dated

08.06.2026 seeking correction of his date of confirmation and to grant all consequential service and monetary benefits. Since no orders have been passed on the representation to date, the present writ petition has been filed. Page4 of 6

¶3Heard the learned counsel for the petitioner and the learned standing counsel appearing for respondent.

¶4Considering the limited scope of the prayer sought in this writ petition, and without expressing any opinion on the merits of the case, this Court directs the respondent to consider the petitioner's representation dated 08.06.2026 and pass appropriate orders on merits and in accordance with law, within a period of three weeks from the date of receipt of a copy of this order.

¶6With the above direction, this Writ Petition is disposed of. No costs. 08-07-2026 Index: Yes/No Speaking/Non-speaking order SRN Page5 of 6 To The Managing Director Metropolitan Transport Corporation (Chennai) Limited, No.2 Pallavan Salai Chennai 600002. Page6 of 6 P.T.ASHA J. SRN 08-07-2026
