Judgment

ORDER The petitioner, who was arrested and remanded to judicial custody on

23.05.2026 for the alleged offences under Sections 123 of BNS in Crime No.478 of 2026 on the file of the respondent police, seeks bail.

¶2The case of the prosecution is that the petitioner, along with the other accused was found in illegal possession of 50 Tapentadol Tablets. Hence the case. Page2 of 4

3.The learned counsel for the petitioner submitted that the petitioner is innocent and has been in custody since 23.05.2026. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court and ready to co-operate for investigation. He further stated that co-accused was granted bail by the learned Principal Sessions Judge, Tiruppur, on 06.07.2026 in Cr.M.P.No.1315 of 2026. Hence, he prays to grant bail to the petitioner.

¶4The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that four previous cases have been registered against the petitioner. He further submitted that there are three accused persons and the petitioner is arrayed as A3; 50 Tapentadol tables have been recovered A1; two syringes were recovered from A2 and one cellphone was recovered from the petitioner. However, he opposed for grant of bail to the petitioner.

5.Though the petitioner has four previous cases, taking into consideration the fact that the co-accused has already been released on bail, and that the petitioner has been incarcerated since 23.05.2026, this court is of the firm view that his further custody is not necessary. Consequently, this Court is inclined to grant bail to the petitioner with certain conditions. Page3 of 4

¶6Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate Court I, Tiruppur, and subject to the following conditions: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [b] the petitioner shall stay at Virudhunagar and report before the Virudhunagar East Police Station daily at 10.30 a.m for a period of two weeks; thereafter as and when required for interrogation before the respondent Police; [c] the petitioner shall not abscond either during investigation or trial; [d] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [e] on breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions had been imposed and the petitioner released on bail by the learned Magistrate/Trial Court itself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283]; Page4 of 4

C.KUMARAPPAN, J. [f] if the petitioner thereafter abscond, a fresh FIR may be registered under Section 269 of the Bharatiya Nyaya Sanhita, 2023. 07-07-2026 ep Note:
