Judgment
ORDER This Criminal Original Petition is filed to quash the FIR in Crime No.54 of 2026 dated 14.03.2026 on the file of the first respondent/Police.
¶2A perusal of the F.I.R reveals that the second respondent/de facto complainant has lodged a complaint alleging that the first accused, claiming to be a creditor, along with the petitioner/second accused, entered her house, caused damage to a mirror and other household articles, pulled her saree, pushed her down, abused her using filthy language and attempted to assault her.
¶3The learned counsel appearing for the petitioner submitted that the second respondent/de facto complainant borrowed money from the petitioner and the instant false complaint has been lodged solely to escape from the financial liability. He further submitted that the de facto complainant was pregnant at the time of the alleged occurrence and the petitioner did not even approach or go near her; that the entire complaint is false and cooked up as no photographic evidence of the alleged damages Page3 of 4 has been produced, nor is there any medical evidence showing injury to any person.
¶4Heard the learned counsel on either side and perused the materials available on record.
¶5The arguments advanced by the learned counsel for the petitioner are purely factual in nature, which cannot be adjudicated by this Court at this stage in a petition to quash. These aspects must be dispassionately considered by the investigating authority during the course of investigation.
¶6However, taking into consideration the hardship pleaded by the petitioner, this Court directs the first respondent/Police to complete the investigation in Crime No.54 of 2026 and file a final report before the jurisdictional Magistrate Court, within a period of two (2) months from the date of receipt of a web-copy of this order. Liberty is granted to the petitioner to agitate the matter afresh and challenge the final report in a manner known to law, in the event if it is filed adversely against him. Page4 of 4
