Judgment
ORDER This Civil Revision Petition has been filed, challenging the impugned order dated 18.04.2026 passed in I.A. No. 5 of 2025 in O.S. No. 81 of 2017 on the file of the Principal Sub Court, Tiruchengode.
¶2In the aforesaid order, the application filed by the petitioner, who is the defendant in the suit, seeking for production of the documents mentioned in I.A. No. 5 of 2025 has been dismissed on the ground that without there being a pleading in the written statement with regard to those documents, the application cannot be entertained.
¶3The suit has been filed by the respondent/plaintiff against the petitioner/defendant, seeking for recovery of money based on promissory notes.
¶4The trial Court, after considering the application and the documents, has rightly held that there was no pleadings by the petitioner/defendant in the written statement with regard to those documents and therefore, the application filed by the petitioner/defendant cannot be entertained.
¶5This Court has also perused and examined the written statement filed by the petitioner/defendant in the suit. The documents disclosed in I.A. No. 5 of 2025 filed by the petitioner/defendant were not pleaded in the written statement filed by the petitioner/defendant. Further, the suit has been filed by the respondent against the petitioner, seeking for recovery of money based on promissory notes.
¶6This Court also fails to understand as to how the documents mentioned in I.A. No. 5 of 2025 are relevant for disproving the case of the respondent/plaintiff against the petitioner/defendant. The suit is of the year 2017 and the application was filed by the petitioner only in the year 2025 when the suit was in the part heard stage. The trial Court has rightly dismissed the said application.
¶7This Court does not find any infirmity in the reasons given by the trial Court for dismissing the application in I.A. No. 5 of 2025 in O.S. No. 81 of 2017.
¶8Accordingly, this Civil Revision Petition is dismissed. No Costs. Consequently, connected miscellaneous petition is closed.
¶9Since no adverse orders are passed against the respondent, notice to the respondent is dispensed with by this Court. 27-07-2026 Index:Yes/No Speaking/Non-speaking order Internet:Yes ab To The Principal District Court, Thiruchengode. ABDUL QUDDHOSE J. ab and CMP No. 18671 of 2026 27-07-2026
