Judgment

ORDER This writ petition has been filed for a mandamus directing the 1st respondent to consider the petitioner's representation dated 02.04.2026 in the light of the circular issued by the Registrar of the Cooperative Societies in Na.Ka. 92635/ 2026 tho.va.sa1(1) dated 26.01.2026 after affording opportunity to the petitioner.

¶2The petitioner would submit that he was working as a Senior Clerk in the second respondent Society and has put in about 28 years of unblemished service. According to the petitioner, the post of Secretary fell vacant on 30.03.2026 upon the retirement of the previous incumbent. The petitioner states that, as per the Registrar's Circular dated 26.01.2026, Page3 of 5 if the post of Assistant Secretary is vacant, the Senior Clerk shall be placed in charge as Secretary-in-charge. Since the post of Assistant Secretary is also vacant, the petitioner claims that, being the senior-most eligible Senior Clerk, he is entitled to be appointed as Secretary-in-charge.

¶3It is the grievance of the petitioner that, despite several requests and a representation dated 02.04.2026, the respondents have neither considered his request nor made any arrangement by appointing a Secretary-in-charge. Aggrieved by the inaction of the respondents, the petitioner has filed the present writ petition seeking the aforesaid relief.

¶4Heard the learned counsel for the petitioner and the learned Government Advocate appearing for respondents.

¶5Considering the limited scope of the prayer sought in this writ petition, and without expressing any opinion on the merits of the case, this Court directs the 1st respondent to consider the petitioner's representation dated 02.04.2026 in the light the circular dated 26.01.2026 and pass appropriate orders on merits and in accordance with law after affording an Page4 of 5 opportunity to the petitioner, within a period of six weeks from the date of receipt of a copy of this order.

¶6With the above direction, this Writ Petition is disposed of. No costs. 08-07-2026 Index: Yes/No Speaking/Non-speaking order SRN To
