ORDER This petition is filed alleging wilful disobedience of the order dated
17.10.2025. On the contempt petition is taken up for hearing, learned counsel for the petitioner contended that this Court, by its order dated 17.10.2025 had directed the respondents to dispose of the appeal filed by the petitioner in terms of the directions contained in clause (2) of para 52 of the said order. It is also contended that though the second respondent had passed an order dated
10.02.2026, the said order is not compliance with the directions contained in para 52 of the order
¶2It is to be noted that this Court vide order in Sub.A.No.909 of 2023 in Cont.P.No.871 of 2021 in W.P.No.6172 of 2011 dated 10.07.2026, had held that the scope of a contempt petition is to bring to the notice of this Court the wilful disobedience of the order by the respondent /contemnor and the petitioner cannot seek to pursue the contempt proceedings as execution proceedings.
¶3Since, in the facts of the present case, the respondent having disposed of the appeal as directed by this Court, though the said disposal is not to the liking of the petitioner, and claims that the said disposal is not in accordance with the directions contained in paragraph No.52 of the order, such a issue cannot be brought under the ambit of contempt jurisdiction, for this Court to Page2 of 4 initiate action against the respondent/contemnor under the Contempt of Courts Act, 1971.
¶4That being so, the petitioner has to work out his remedy available against the said order and cannot initiate the contempt petition alleging wilful disobedience of the order.
¶5In view of the above, contempt petition is devoid of merits and is liable to be dismissed.
¶6Accordingly, the contempt petition is dismissed.
