Judgment

ORDER The petitioner seeks modification of the condition imposed by the learned Judicial Magistrate No.III, Vellore, by order dated 26.05.2026 in Crl.M.P.No.4557 of 2026 while granting interim custody of the vehicle belonging to the petitioner. Page1 of 4

¶2The petitioner is an accused in this case, which is registered for the alleged offences under Sections 296(b), 115(2), 315(3), 318(4) of BNS. The allegation is that the petitioner is said to have cheated the de facto complainant to the tune of Rs.18,70,000/- and in this regard the Car of the petitioner was seized and produced before the Court. The Court has now returned the property for the interim custody of the petitioner, however imposed a condition to execute a bond of Rs.20,00,000/-.

¶3The learned counsel for the petitioner submitted that the said condition is onerous.

¶4The learned Government Advocate (Crl. Side) submitted that considering the overall facts and circumstances of the case, the quantum of cheating and to the nature of the Car, the condition has been imposed.

¶5I have considered the rival submissions made on either side and perused the material records of the case.

¶6It can be seen that the vehicle involved is Skoda Slavia Car produced in the year 2024 and from the Insurance Policy, the value of the vehicle is taken as Rs.11,51,200/-. Considering that now we are in the year 2026 and considering the overall facts and circumstances of the case, I am of the view that the Page2 of 4 quantum mentioned in the condition would be modified to one of Rs.7,00,000/- instead of Rs.20,00,000/-. In view thereof, the condition imposed in paragraph 6(i) in the order dated 26.05.2026 in Crl.M.P.No.4557 of 2026 is modified as follows: The petitioner shall appear and execute a bond for Rs.7,00,000/- (Rupees seven lakhs only) with two sureties each for a sum of Rs.50,000/- to the satisfaction of the Court. The other conditions remain unaltered. Accordingly, this Criminal Original Petition is disposed of. 03-07-2026 Index: No Speaking order PVS To
