ORDER The prayer in the Criminal Original Petition is to quash the First Information Report in Crime No.110 of 2026.
¶2Upon perusal of the First Information Report, it can be seen that upon the vehicles, which were transporting minerals were intercepted on allegation that the minerals were being transported without any valid permission, the case has been registered.
¶3The primary contention of the learned counsel for the petitioner is that when four vehicles were intercepted, due permits were produced at the relevant spot itself and only with reference to one vehicle, the permit was not taken together with them and even though subsequently they sought to produce the same, the same is not being taken into account.
¶4The learned counsel would also submit that the transmit permits have also been annexed along with the typed set of papers and they are unimpeachable documents, therefore FIR should be quashed.
¶5I have considered the said submissions of the learned counsel for the petitioner. Page3 of 4
¶6When on the spot, the permit was not produced, no exception cane be taken for the registration of FIR and commencing the investigation. If subsequently it is the case of the petitioner that there were permits for all the transport, let these permits, which are now produced along with the typed set of papers, shall be taken into consideration by the Investigating Officer and the investigation shall be duly proceeded with. The Investigating Officer shall dispassionately consider whether the transport was only with the permit and if so, accordingly conclude the issue.
¶7With the aforesaid directions and directing the respondent Investigating Officer to complete the investigation as expeditiously as possible, in any event, within two months and keeping open the liberty of the petitioner to agitate the issue if necessary at the appropriate stage, the petition stands disposed of. Consequently, connected miscellaneous petition is closed. 27-07-2026 PVS To
