¶2The case of the prosecution is that during a death ceremony, a wordy quarrel arose between the petitioner, other accused persons and the defacto-complainant. It is alleged that during the altercation, the petitioner along with Page2 of 4 other accused persons attacked the defacto-complainant with a knife causing injuries to him. Hence the case.
3.The learned counsel for the petitioner submitted that the petitioner is innocent and has been in custody since 01.06.2026. He further submitted that the occurrence took place on 23.05.2026. He further stated that the petitioner is ready to abide by any stringent condition that may be imposed by this Court and is ready to co-operate for investigation. Hence, he prays to grant bail to the petitioner.
4.At this juncture, the learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and upon instructions, submitted that one previous case of hurt has been registered against the petitioner. He further submitted that the injured person was discharged from the hospital on 27.05.2026. However, he prayed for dismissal of this application.
5.Although the petitioner has one previous case, considering that the injured person has already been discharged from the hospital, and that the petitioner has been incarcerated since 01.06.2026, this Court is of the firm view that his further custody is not required for the purpose of investigation. Hence, this Court is inclined to grant bail to the petitioner with certain conditions. Page3 of 4
