Judgment

ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the respondents 1 and 4 to consider the petitioner's online application dated 29.01.2026.

¶2The case of the petitioner is that he submitted an online application dated 29.01.2026 to the 4th respondent, requesting a comprehensive survey and field measurement of the lands comprised in Survey No. 81, including Survey Nos. 81/5, 81/6, 81/23, and the sub-divisions bearing Survey Nos. 81/24 to 81/27 (part), along with other sub-divisions therein, situated at Kuchur Village, Kattumannarkoil Taluk, Cuddalore District. However, the same has not been considered till date. Aggrieved by the inaction on the part of the respondents, the petitioner has filed the present Writ Petition.

¶3The learned Government Counsel appearing for the official respondents submitted that no such application has been received by the respondents from the petitioner. However, he fairly submitted that in the event a Page3 of 6 fresh application is filed by the petitioner, the same will be considered and appropriate orders will be passed thereon.

¶4In view of the facts and circumstances of the case and the submissions made by the learned counsel on either side, this Court directs the petitioner to file a fresh online application within a period of two (2) weeks from the date of receipt of a copy of this order. Upon receipt of such application, the official respondents are directed to consider the same and conduct a survey of the subject property, after issuing prior notice to the petitioner, the adjacent landowners, and any other interested parties. The entire exercise shall be completed within a period of six (6) weeks from the date of receipt of the fresh application from the petitioner. It is made clear that in the event that any disturbance arises, the surveying authority is empowered to seek the assistance of the jurisdictional Police, and the jurisdictional Police are mandated to provide necessary police protection. In the event that the subject land under survey is in the possession of either the petitioner or any other concerned party, the recovery of possession can only be effected through the due process of law before the competent Civil Court; under no circumstances shall the respondents engage in taking over possession after completing the survey to hand it over to any party. Such exercise shall be carried out exclusively through the competent Civil Court. Page4 of 6
