ORDER This Writ Petition has been filed seeking a direction to respondents 1 to 3 to conduct an enquiry and register an FIR against respondents 4 and 5 and their henchmen based on the first petitioner's complaint dated 11.06.2026, registered as CSR No.0260 of 2026 by the third respondent. Page3 of 6
¶2The petitioners lodged a complaint against respondents 4 and 5 alleging that the first petitioner had borrowed a huge sum of money from them to the tune of Rs.4,46,54,000/-, out of which a substantial amount had already been repaid. According to the petitioners, despite such repayment, respondents 4 and 5, along with their henchmen, came to the petitioners' residence, demanded huge amounts with exorbitant interest, and threatened the petitioners with dire consequences. Hence, the petitioners lodged the complaint before the second respondent.
¶3Pursuant to the complaint, the second respondent conducted an enquiry and found that there had been monetary transactions between the parties and that a sum of Rs.40,000/- was allegedly due from the petitioners. Taking note of the monetary dispute between the parties, the second respondent closed the complaint.
¶4The learned counsel appearing for the petitioners submitted that the second respondent failed to take appropriate action against respondents 4 and 5, even though the allegations disclosed cognizable offences. He further submitted that the petitioners were harassed and compelled by the second respondent to settle the alleged dues payable to respondents 4 and 5. Merely because there are monetary transactions between the parties, the second respondent ought not to Page4 of 6 have compelled the petitioners to settle the alleged dues. The dispute relating to the money transaction is essentially civil in nature.
¶5The learned counsel for the petitioners further submitted that the petitioners apprehend threat from Advocates while filing a private complaint before the Judicial Magistrate Court, Madhavaram.
¶6In view of the above, the second respondent shall not interfere in the monetary transactions between the petitioners and respondents 4 and 5, as the same is essentially a civil dispute. If the petitioners are aggrieved by the closure of the complaint by the second respondent and apprehension, the petitioners are at liberty to file a private complaint before the Judicial Magistrate-I, Poonamallee, if they are so advised.
¶7With the above directions, this Writ Petition is disposed of. No costs. Consequently, the connected Miscellaneous Petition is closed. 07-07-2026 Index: Yes/No Speaking/Non-speaking order Vv Page5 of 6 To
