Judgment
ORDER The petitioner/A4 in C.C.No.166 of 2022 was convicted by the Trial Court, by the judgment dated 16.10.2025 and sentenced to undergo fourteen years rigorous imprisonment and to pay a fine of Rs.1,00,000/- for the offence under Section 8(c) r/w 25 of NDPS Act, 1985 and sentenced to undergo fourteen years rigorous imprisonment and to pay a fine of Rs.1,00,000/- for the offence under Section 8(c) r/w 29(1) of NDPS Act, 1985. Aggrieved against his conviction, the petitioner preferred the above appeal in Crl.A.No.1716 of 2025 along with suspension of sentence petition in Crl.M.P.No.20923 of 2025.
¶2This Court, by order dated 20.11.2025, suspended the sentence of the petitioner and granted bail with certain conditions. One of the conditions was that the petitioner to appear before the Trial Court on every Monday at 10.30 a.m., until the disposal of the appeal. The present petition is filed seeking relaxation of the said condition.
¶3The learned Counsel for Government of Tamilnadu (Criminal Side) filed counter affidavit of Ms.S.Srinidhi, Deputy Superintendent of Police, NIBCID, Coimbatore, wherein she narrated about the sequence of case and the witnesses examined. In para 11 of the counter, she submitted as follows: Page3 of 4 "11. It is further submitted that the appellant/A4 has no previous case against him based on ICJS portal."
¶4It is seen that, on earlier occasion this Court wanted to verify as to whether the petitioner has got any previous case. In view of the report submitted by the Deputy Superintendent of Police, it is seen that there is no previous case against the petitioner herein. Hence, this Court is inclined to modify the condition.
¶5Accordingly, the condition No.6(c) of the order dated 20.11.2025 made in Crl.M.P.No.20923 of 2025 in Crl.A.No.1716 of 2025 is modified to the effect that the petitioner shall appear before the trial Court on the first working day of every month at 10.30 a.m., till the disposal of the appeal and if he is not able to appear before the Trial Court on that day, he shall make arrangements to file an application under Section 317 Cr.P.C. and shall appear before the Trial Court on any other day in lieu of the date of his absence as directed by the Trial Court. All other conditions remain unaltered. 24-07-2026 Index: Yes/No Speaking/Non-speaking order RSI Page4 of 4 M.NIRMAL KUMAR J. RSI To
