Judgment

ORDER (Order of the Court was made by Sunder Mohan J.) The petitioner, whose son has been detained under Act 14 of 1982, and has filed a Habeas Corpus Petition in HCP.No.797 of 2026, has sought for temporary release of her son/detenu for a period of 10 days. Page3 of 5

2.The reasons stated by the petitioner for temporary release is that the detenu jointly owns a property along with the petitioner and his brother and in order to meet their financial requirements, they have decided to sell the property and the detenu's release is necessary to execute the sale deed.

3.The learned counsel for the petitioner would submit that though the prayer is for temporary release for 10 days, it would suffice if the detenu is released for a day, with escort, for the purpose of registration of the sale deed.

4.Heard the learned counsel for Government of Tamil Nadu (Criminal Side) for the respondents.

5.Considering the fact that the request is genuine, we are inclined to direct the release of the detenu, with escort, from morning to evening on any day specified by the petitioner, when the registration of the sale deed is scheduled. The petitioner shall inform the authorities concerned, the date of registration. The authorities shall release the petitioner, with escort, on that day, between 10.00 a.m. and 05.00 p.m., for the purpose of the execution of the sale deed. Page4 of 5

6.With the above observations, the petition is allowed. (A.S.M.,J.) (S.M.,J.) 29-07-2026 Index: Yes/No Speaking/Non-speaking order TSG Note: Issue order copy today. To
