Judgment

ORDER This writ petition has been filed seeking the issuance of a writ of mandamus directing the respondent to include one year training period for calculating gratuity and pay the difference in the Gratuity amount along with interest at the rate of 10% to the petitioner.

¶2It is the case of the petitioner that he joined the respondent Corporation as a Trainee on 01.06.1985. After the successful completion of one year training, he was appointed as Junior Assistant with effect from

02.06.1986. He rendered more than 30 years of service and retired as Senior Superintendent on 30.04.2016.

¶3The grievance of the petitioner is that, while settling his gratuity, the respondent did not take into account the one-year training period for calculating gratuity. According to the petitioner, the training period has Page3 of 5 been included for calculating gratuity in other regions of the Tamil Nadu State Transport Corporation (Villupuram) Ltd. The petitioner submitted a representation dated 08.06.2026 seeking inclusion of the training period for the calculation of gratuity and payment of the differential gratuity with interest. Since no orders have been passed on the said representation, the petitioner has filed the present writ petition.

¶3Heard the learned counsel for the petitioner and the learned standing counsel appearing for respondent.

¶4Considering the limited scope of the prayer sought in this writ petition, and without expressing any opinion on the merits of the case, this Court directs the respondent to consider the petitioner's representation dated 08.06.2026 and pass appropriate orders on merits and in accordance with law regarding the inclusion of the training period for the calculation of gratuity and payment of the differential gratuity with interest, if the petitioner is found eligible. The said exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order. Page4 of 5
