Judgment

ORDER The petitioner, who was arrested and remanded to judicial custody on

27.03.2026 for the alleged offence under 8 (c) read with 20(b)(ii)(C), 25 and 29(1) of the NDPS Act 1985, in Crime No.0067 of 2026 on the file of the respondent police, seeks bail. Page2 of 4

¶2The case of the prosecution is that the petitioner, along with other accused, was found to be in illegal possession of 33.170 kgs of ganja. Hence, this case.

¶3The learned counsel for the petitioner submitted that this is the second bail application filed by the petitioner, as the earlier bail application was dismissed on the ground that the quantity of contraband involved is commercial quantity. He further submitted that the petitioner has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is in custody since 27.03.2026 and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioner.

¶4The learned Government Advocate (Crl. Side) strongly opposed the bail application on the ground that this Court on 10.06.2026 has dismissed the earlier bail application after considering all the contentions put forth by the learned counsel for the petitioner. He further submitted that there are no changes in the circumstances. Hence, he opposed the grant of bail to the petitioner.

¶5I have given my anxious consideration to either side submissions and Page3 of 4 perused the materials available on record.

¶6Considering the facts and circumstances of the case; taking note of the submission made by the learned Government Advocate (Crl.Side); it is seen that this is a case of commercial quantity and the bail application of this petitioner was earlier dismissed on 10.06.2026 and the petitioner could not submit any ground to deviate from the earlier finding, thus this Court is of the view that there is no change in circumstances, hence, this Court is not inclined to enlarge the petitioner on bail.

¶7Accordingly, this Criminal Original Petition stands dismissed. 09-07-2026 DRL To
