Official Liquidator of High Court, Madras v. Nil

ORDER This Company Application has been filed seeking for the following reliefs:- a) To take this Report on record, b) To permit the Official Liquidator to engage the services of the approved Auctioneer M/s.Alwin & Co., or any other Auctioneer from the panel of this Hon'ble Court to value and sell Toyata camrey car. c) To permit the Official Liquidator to conduct the sale of above car (Toyata Camrey car) based on the valuation of auctioneer and also confirm the sale on the spot to the highest bidder. d)To permit the Official Liquidator to deliver the car to the successful bidder on remittance of entire sale consideration without approaching this Hon'ble Court. e)To permit the Official Liquidator to use the Toyata Innova car for official purposes permanently as already permitted by this Hon'ble Court vide order dated 25.04.2017 in CA.No.302 of 2017. f)To permit the Official Liquidator to defray the expenses for valuation and other incidental expenses in connection with sale of two cars from the funds of the company in liquidation. g) To direct that the cost of this application do come out of the funds of the company in provisional liquidation; and f) To pass any other order/ as this Hon'ble Court may deem fit and proper in the circumstances of the case.

¶3I have perused the contents of the Report filed by the Official Liquidator upon which the application had been made before this Court and having been satisfied with the reasons stated therein, I am inclined to allow this application as prayed for.
