Judgment

Order This Writ Petition has been filed to direct the respondent to receive the settlement deed dated 12.06.2026 executed by the petitioner and register the same in accordance with the provisions of Registration Act.

¶2The learned counsel for the petitioner submitted that the property situated in Old S.F. No. 132/6, New S.F. No. 132/6A, present S.F. No. 132/6A, Page2 of 4 measuring 2925 sq. ft., bearing Ward No. 2, Bairantham Village, Dharmapuri District, was originally owned by the petitioner's father. During his lifetime, the petitioner's father executed a registered Will dated 22.01.1999, bequeathing the said property in favour of the petitioner for his lifetime, and thereafter to his legal heirs.

¶3It is submitted that the petitioner remains unmarried and has decided to settle the property in favour of his mother and sister. Accordingly, he executed a Settlement Deed and presented the same for registration before the respondent, along with all relevant documents. However, the respondent refused to register the document, relying on a clause in the Will which stipulates that after the petitioner's lifetime, the property shall absolutely devolve upon his unborn children. Aggrieved by the non-registration of the Settlement Deed, the petitioner has preferred this Writ Petition.

¶4The learned Government Counsel appearing for the respondent submitted that no such Settlement Deed has been presented for registration as of date, and further submitted that if the document is presented, the same will be considered and registered in accordance with law.

¶5Heard both sides and perused the materials available on record. Page3 of 4

¶6Since the document in question is a Settlement Deed, it is entirely within the domain of the petitioner to decide the beneficiaries of the settlement. Furthermore, as the petitioner is currently unmarried, the respondent ought not to have refused registration by pointing the restrictive clauses of the Will. It is the absolute privilege of the petitioner to settle his life interest or available rights in favour of his mother and sister.

¶7Under such circumstances, this Court directs the petitioner to present the Settlement Deed dated 02.12.2026 before the respondent authority. Upon such presentation, the respondent is directed to receive and register the same in accordance with law, within a period of six weeks from the date of receipt of the document.

¶8With the above observations and directions, this Writ Petition stands disposed of. No costs. 13-07-2026 Index: Yes/No Speaking/Non-speaking order SK To The Sub Registrar Pappireddipatti Dharmapuri District. WPoNo.o26897oofo2026 KRISHNANoRAMASAMYoJ. sk WPoNo.o26897oofo2026 13-07-2026 Page4oofo4
