ORDER This Writ Petition has been filed for the following reliefs:-"Directing the respondents herein to approve the appointment of the petitioner with effect from 16.03.2020 to the post of secondary grade teacher by taking into account the fact that her name placed in the annexure to G.O.Ms.No.300 School Education Department dated 24.12.2025 and that her appointment is prior to 31.03.2021 and grant her with all service and monetary benefits." Brief Facts:-

¶2The case of the petitioner is that she was appointed as a Teacher on

16.03.2020 in a sanctioned vacancy that arose on account of the termination of one Tmt. I. Arul Mozhi in a Government-aided Minority Educational Institution. Immediately thereafter, the School Management forwarded a proposal dated 17.03.2020 seeking approval of the petitioner's appointment. However, the said proposal was returned by the educational authorities on

20.05.2020 by placing reliance on G.O.Ms. No.165, School Education Department, dated 17.09.2019. Aggrieved by the return of the proposal, the Educational Agency preferred a statutory appeal before the District Educational Officer on 16.07.2020, which is still pending. Subsequently, the Division Bench of this Court, by judgment dated 31.03.2021 in W.A. No.76 of 2019 and batch Page3 of 5 cases, held that G.O.Ms. No.165 could not be enforced against Minority Educational Institutions to deny approval of appointments made in sanctioned vacancies.

¶3Thereafter, the Government had issued G.O.Ms. No.300, School Education Department, dated 24.12.2025, granting approval to appointments of teachers made in aided Minority Educational Institutions prior to 31.01.2023, and the petitioner's name finds place at Sl. No.82 in the Annexure to the said Government Order. The petitioner has also acquired the requisite Teachers Eligibility Test (TET) qualification on 15.11.2025.

¶4Despite the above developments and repeated representations, the respondents have not approved the petitioner's appointment. Hence, the petitioner has filed the present Writ Petition.

¶5When the matter was taken up for hearing, the learned Government Advocate submitted that the 4th respondent institution had already preferred an appeal before the 2nd respondent against the return of the proposal seeking approval of the petitioner's appointment and the said appeal is still pending consideration. ¶6Though this Writ Petition has been filed for the reliefs stated supra, considering the submissions of the learned Government Advocate, without going into the merits of the case, this Writ Petition is disposed of. The 2nd respondent is directed to consider and pass appropriate orders on the appeal preferred by the 4th respondent institution, taking into consideration the dicta laid down by this Court in the case of Secretary to Government and Others v. Iruthaya Amali and Another, reported in 2021 SCC OnLine Mad 1285, and the judgment in W.A. No.2134 of 2024, within a period of eight (8) weeks from the date of receipt of a copy of this order.
