ORDER This writ petition has been filed seeking a direction to the 2nd respondent to consider and dispose of the petitioner's representation dated 01.06.2026, and consequently disburse his retirement benefits including Gratuity, General Provident Fund, Special Provident Fund, Encashment of Earned Leave, and Encashment of Unearned Leave on Private Affairs within a stipulated time frame to be fixed by this Court.
¶2The case of the petitioner is that he joined the 2nd respondent Society as a Clerk in the year 1990. On 07.02.2007, he was placed under suspension in connection with a criminal case concerning alleged irregularities in the sanctioning of bogus jewel loans. Based on an enquiry conducted under Section 81 of the Tamil Nadu Cooperative Societies Act, surcharge proceedings were initiated against him, and he was subsequently terminated from service on
29.11.2011. Aggrieved by the surcharge order, the petitioner preferred C.M.A.C.S. No. 5 of 2011 before the Cooperative Tribunal / District Court, Ariyalur, which, by a judgment dated 14.09.2012, allowed the appeal and set aside the surcharge proceedings. Simultaneously, the criminal proceedings arising out of the very same Section 81 enquiry culminated in ten charge sheets, in all of which the petitioner was acquitted by the Judicial Magistrate-I, Ariyalur, on 29.01.2026. Since both the surcharge proceedings and criminal cases have ended in his favour, and given that the petitioner attained the age of Page3 of 4 superannuation on 12.06.2018, he submitted a representation dated 01.06.2026 seeking the revocation of his termination order and the disbursement of his retirement benefits, including Gratuity, General Provident Fund, Special Provident Fund, Encashment of Earned Leave, and Encashment of Unearned Leave on Private Affairs. As the said representation has not been considered to date, the present writ petition has been filed.
¶3Heard the learned counsel appearing on either side.
¶4Considering the limited relief sought in the writ petition, without expressing any opinion on the merits of the petitioner's claim, the second respondent is directed to consider the petitioner's representation dated
01.06.2026 and pass appropriate orders on merits and in accordance with law, after affording an opportunity of hearing to the petitioner and all affected parties, if any, within a period of six weeks from the date of receipt of a copy of this order.
¶5With the above directions, this writ petition is disposed of. No costs. 17-07-2026 Index: Yes/No Speaking/Non-speaking order MRP Page4 of 4
